For the purposes of the European Data Protection Regulation EU 2016/679, of April 27, of the Parliament and the Council (hereinafter, “RGPD”) and other current national regulations, José Entrecanales Ibarra Foundation, informs you that it fully complies with current legislation on the protection of personal data, and with the confidentiality commitments specific to its activity.

Treatment, they are required to comply with the aforementioned regulations, with special attention to their functions and obligations, including the duty of secrecy.

RESPONSIBLE FOR THE PROCESSING OF PERSONAL DATA

TYPE AND COLLECTION OF PERSONAL DATA

Personal data will be requested through forms or the website. At the time the data is collected, the user will be duly informed of their rights.

The data collected by the Foundation are identifying data, that is: name, email address, postal address, telephone number, date of birth, gender, academic data. The Foundation does not collect special categories of personal data. La

The Foundation also collects professional data, such as the organization to which it belongs and position of work in it.

So that the information contained in our treatment system is always up to date and free of errors, we ask our customers and users to inform us, as soon as possible, of the modifications and corrections of their personal data.

PURPOSES AND LEGAL BASIS OF THE TREATMENT

The Foundation informs you that your data will be processed for the following purposes:

  • Communication and information on the implementation of activities carried out by the Foundation to promote engineering
  • Management for the granting of scholarships for the completion of doctoral theses and other grants
  • Management for the award of prizes to the best doctoral theses

The legal bases that legitimate the Foundation for the processing of your data are the following:

  • The consent of the interested party: for the granting of scholarships and prizes, as well as for receiving information about the activities carried out by the Foundation to honor engineering.
  • The legitimate interest of the Foundation: for the same purposes expressed above.

At the time of the request for personal data, the following information will be communicated to the client or user: (i) identity and address of the Foundation, (ii) recipient of the personal data, (iii) purpose for which the data is collected, (iv) legal basis for the processing, (v) period during which the data will be kept, and (vi) the user's right to exercise the rights of access, opposition, rectification, cancellation or deletion, revocation of consent, limitation of data processing and portability, and to present complaint to the AEPD.

It will be understood that the user gives their express consent so that the Foundation can make use of their personal data, once they have completed the data collection form and click on the corresponding box.

RECIPIENTS OF PERSONAL DATA

Your personal data may be transferred/communicated to the following recipients:

  • Public Administrations and Bodies when required by any applicable regulations.
  • Companies responsible for data processing (suppliers): Centro de Asesorio y Gestión Integral de Serviços SL, Alberto Bornstein as accounting advisor, the auditor who is appointed annually and event organization companies for special occasions.

The Foundation will not transfer personal data without the express consent of its owners, which must be granted on each occasion, being only transferred to the recipients expressed above.

The Foundation will not make international data transfers. However, if they are carried out, the interested party will be informed in advance and the interested party's express consent will be obtained. The Foundation will use the Standard Contractual Clauses adapted by the European Commission and the EU-US Privacy Shield as a guarantee for transfers made to countries that do not have an adequate decision from the European Commission. In any case, the third parties with whom certain personal data are shared will have previously accredited the adoption of appropriate technical and organizational measures for the proper protection of the same.

PERIOD OF STORAGE OF PERSONAL DATA

The Foundation will keep personal data only for as long as reasonably necessary. Regardless of whether we process your data for the time strictly necessary to fulfill the corresponding purposes, we will then keep them duly stored and protected for as long as responsibilities may arise from the treatment, in compliance with the regulations in force at all times. Once the possible actions have been prescribed in each case, we will proceed to delete the personal data.

EXERCISE OF RIGHTS

The Foundation informs you about your rights as the owner of your data:

  • Right of access: You have the right to obtain confirmation from the Foundation as to whether personal data about you is being processed and to obtain a copy of them.
  • Right to object: You have the right to object at any time to the personal data concerning you being processed based on the public or legitimate interest pursued by the Foundation. In this case, the Foundation will stop processing the data, except for compelling legitimate reasons or the exercise or defense of possible claims.
  • Right to rectification: You have the right to request the Foundation to rectify your data when they are incorrect, inaccurate or incomplete.
  • Right of deletion: You have the right to request the Foundation to delete personal data concerning you, when, among other reasons, the data are no longer necessary for the purposes for which they were collected.
  • Right of limitation: You have the right to request the limitation of the processing of your data, in which case the Foundation will only keep them for the exercise of rights or defense of claims.
  • Right to withdraw consent: You have the right to withdraw your consent at any time.
  • Right of portability: You have the right to request the personal data that concerns you and that you have provided to the Foundation in a structured, commonly used and machine-readable format.

To exercise the above-mentioned rights, you must either fill out the form available on our website, or send a written communication to Fundación José Entrecanales Ibarra, E.T.S. Engineers of Roads, Canals and Ports, C/ Profesor Aranguren, s/n, of Madrid, C.P. 28040, Spain, providing a photocopy of your ID or equivalent document and identifying the right being requested.

In addition, if you consider that your right to the protection of personal data has been violated, you have the right to file a complaint with the Spanish Data Protection Agency (www.aepd.es).

SECURITY MEASURES AND LEVELS

The Foundation has adopted the necessary measures to guarantee information security, as required by art. 32 of the GDPR, depending on the nature of the personal data processed and the circumstances of the processing, in order to avoid, as far as possible and always according to the state of the art, their alteration, loss, treatment or unauthorized access, thus guaranteeing their confidentiality, integrity and availability.

CONFIDENTIALITY AND PROFESSIONAL SECRECY

The data collected in all private communications between the Foundation and clients or users will be treated with absolute confidentiality, and the Foundation is committed to the obligation of secrecy of personal data.

In addition, information of any kind that the parties exchange with each other, that which they agree is of such nature, or that which is simply viewed on the content of said information, will also have the condition of confidentiality.

We recommend that the client or user not provide to any third party their identification, password or reference numbers that the Foundation may provide. In addition, to ensure that the protection of professional secrecy between the Foundation and the client or user is preserved in all communications, the client or user must not disclose confidential information to third parties.

CHANGES TO THE PRIVACY POLICY

The Foundation reserves the right to modify its privacy policy in order to adapt it to legislative or jurisprudential developments, as well as those that may derive from existing standard codes in the field, or by strategic corporate decisions, with effect from the date of publication of said modification on the Foundation's website.
