G-82559501, registered in the Register of Foundations of the Madrid, Personal Sheet 208, Volume XXI, Folio 418-421, whose address is at Escuela Técnica Superior de Ingenieros de Roads, Canales y Ports, Calle Profesor Aranguren, s/n -28040 Madrid. 2. CONTENT OF THE LEGAL NOTICE
2.1 Acceptance of the Legal Notice
This Legal Notice regulates the use by users of the information society services that the FOUNDATION makes available via the Internet on the Website.
Access and use of the Website by the user (hereinafter, either of them, the “User”) implies that the user fully accepts and undertakes to fully comply with the terms and conditions set out in this Legal Notice, as well as in the Policy of
Portal Privacy. Therefore, the User must read this Legal Notice carefully each time they intend to use the Portal, since it and its conditions of use may change.
2.2 Terms of Use of the Portal
Access to the Website is free, except for the cost of connecting through the telecommunications network provided by the access provider that the User has contracted.
The User undertakes not to use the Website for fraudulent purposes and not to carry out any conduct that could damage the image, interests and rights of the FOUNDATION or third parties. In addition, the User undertakes not to perform any act in order to damage, disable or overload the Website, or to prevent, in any way, the normal use and operation of the Website.
The User is informed that in the event that they do not comply with the content of this Legal Notice, the Privacy Policy or any other specific terms or conditions contained in the Portal, the FOUNDATION reserves the right to limit, suspend or terminate their access to the Website, taking any technical measure that is necessary for that purpose. In addition, the FOUNDATION reserves the right to exercise such measures in the event that it reasonably suspects that the User is violating any of the terms and conditions contained in the above-mentioned instruments.
Finally, we inform the User that the FOUNDATION reserves, at all times, the right to decide on the continuity of the information society services it provides through the Portal.
2.3 Intellectual and Industrial Property
The intellectual property rights over the layout of the contents of the Portal (sui generis right based on the database), its graphic design (look & feel), the underlying computer programs (including source codes), and the different elements that make up the Portal -texts, graphics, photographs, videos, sound recordings, etc .- (hereinafter, the “Contents”), correspond to the FOUNDATION or its licensors.
The industrial property rights and distinctive signs included in the Portal (brands and commercial names) are the property of the FOUNDATION or its licensors.
The use of the Portal by the User does not imply the transfer of any intellectual and/or industrial property right to the Portal, the Contents and/or the distinctive signs of the FOUNDATION. For this purpose, through this Legal Notice, except in those cases where legally permitted or with prior authorization from the FOUNDATION, the User is expressly prohibited from reproducing, transforming, distributing, communicating publicly, making available, extracting and/or reusing the Portal, its Contents and/or the distinctive signs of the FOUNDATION.
2.4 Link Policy
2.4.1 Establishing links with the Portal
The establishment of links to the Website is prohibited, unless it has been previously authorized by the Company. In any case, once the link has been authorized by the FOUNDATION, it must be established in the following terms:
(i) The link will only link to the home page or main page of the Portal.
(ii) The link may not consist of frames or frames that allow viewing of the Portal through Internet addresses other than those of the Website or that in any other way show together the information on the Portal with that included in other web pages.
(iii) No false, inaccurate or incorrect statement about the Portal will be made from the web page that introduces the link (hereinafter, the “Linking Site”).
(iv) Under no circumstances does the authorization granted by the FOUNDATION mean that (a) it sponsors, collaborates, verifies or monitors the content and/or services provided through the Linking Site; (b) nor that it is responsible for the content of the Linking Site.
(v) The Linking Site must faithfully comply with the Law and may not under any circumstances contain content, its own or that of third parties, that (a) is illegal, harmful or contrary to morals and good customs (pornographic, violent, racist, etc.); (b) induces or may induce in the User the false conception that the Company subscribes to, supports, adheres to or in any way supports, the sender's ideas, statements or expressions; (c) are inappropriate or not relevant in relation to the activity of the FOUNDATION.
In the event of non-compliance with any of the terms stated above, the FOUNDATION will proceed immediately and without prior notification to delete the link.
2.4.2 Linked Sites
To help you find additional information, we have included various technical link devices that allow the User to access other websites (hereinafter, the “Linked Sites”). In these cases, the FOUNDATION acts as a provider of brokerage services, as provided in Article 17 of the LSSI. In accordance with the provisions of the aforementioned legislation, the Company will not be responsible for the services and
content provided through the Linked Sites, unless you have effective knowledge of the illegality and have not deactivated the link with due diligence.
Under no circumstances does the existence of Linked Sites imply recommendation, promotion, identification or agreement by the FOUNDATION with the statements, content or services provided through the Linked Sites. Consequently, the FOUNDATION is not responsible for the content of the Linked Sites, nor for their terms of use and privacy policies, and the User is solely responsible for checking and accepting them each time they access and use them.
In particular, the FOUNDATION informs the User of the following: (i) the FOUNDATION provides only and exclusively information provided by the owners of the Linked Sites and, (ii) the FOUNDATION is not responsible for the accuracy or veracity of the information provided on the Linked Sites.
In the event that the User considers that illegal, harmful, denigrating, violent or inappropriate content exists on the Linked Sites, he may inform the FOUNDATION through the following email address: info@fentrecanalesibarra.es. However, under no circumstances will such communication entail the Company's obligation to remove the corresponding link, nor does it necessarily imply effective knowledge of the FOUNDATION of the illegality of the contents of the Linked Site, for the purposes of the provisions of current regulations.
2.5 Communication of illegal and inappropriate activities
In the event that the User or any other Internet user is aware that any type of information or content on the Portal or provided through it is illegal, harmful to the rights of third parties, contrary to what is established in this Legal Notice or, in any other way, harmful or contrary to morals, uses and customs, you can contact the FOUNDATION indicating the following points:
(i) Personal data of the reporting User: name, address, telephone number and email address.
(ii) Description of the facts that reveal the illegal or inappropriate nature of the content or information as well as the specific address at which it is available.
(iii) In the event of a violation of the rights of third parties, such as intellectual and industrial property, the data of the owner of the infringed right must be provided when he is a person other than the complainant. You must also provide the title certifying the ownership of the violated rights and, where appropriate, the representation to act on behalf of the owner when he is a person other than the complainant.
The receipt by the FOUNDATION of the communication provided for in this clause will not imply, in accordance with the provisions of the LSSI, effective knowledge of the activities and/or contents indicated by the caller when this is not obvious or obvious. In any case, the FOUNDATION reserves the right to suspend or remove content that, even if not illegal, is contrary to the rules established in this Legal Notice, weighing in each case the legal assets in conflict.
2.6 Responsibility of the FOUNDATION
The User should know that communications through open networks are exposed to a variety of threats that make them not secure. It is the User's responsibility to adopt all appropriate technical measures to reasonably control these threats and, among them, to have up-to-date systems for detecting malicious software, such as viruses, trojans, etc., as well as updated security patches in the corresponding browsers. For more information, you can contact your Internet access service provider who can provide you with solutions appropriate to your needs. The FOUNDATION is not responsible for damages caused to the User as a result of risks inherent to the environment used, nor for those caused by vulnerabilities in its systems and tools. Nor does the FOUNDATION guarantee the total security of its systems and although it has adopted appropriate security measures, the existence of vulnerabilities cannot be completely ruled out and, consequently, the User must be cautious when interacting with the Portal. The FOUNDATION will only be responsible for damages caused by the use of the Portal, when such damages are directly caused by intent or serious negligence on the part of the Company and there has been no negligence on the part of the User.
In particular, the FOUNDATION will not be responsible for:
(i) Damages of any kind caused to the User's computer equipment by viruses, worms, trojans or any other harmful element.
(ii) Damages of any kind caused to the User that result in failures or disconnections in telecommunications networks that result in the suspension, cancellation or interruption of the Portal service during the provision of the Portal. In this regard, the User recognizes that access to the Portal requires services provided by third parties outside the FOUNDATION's control (for example: telecommunications network operators, access providers, etc.) whose reliability, quality, continuity and operation are not the responsibility of the FOUNDATION, nor is it part of its responsibility to guarantee the availability of the service.
(iii) Information from third parties in cases where they act as a provider of brokerage services in the sense given by the LSSI, unless there is effective knowledge and the corresponding information has not been removed.
2.7 Data Protection
As indicated in section 2.1 of this Legal Notice, aspects relating to the processing of Users' personal data due to the use of the Portal are regulated by the Privacy Policy, as well as in the legal texts attached to the various data collection forms included in the Portal, which form an integral part of this Legal Notice.
2.8 Miscellaneous
In accordance with Article 3 of the LSSI, the laws applicable to the information society services that the Company provides through the Portal will be those of the Kingdom of Spain.
If any of the provisions contained in this Legal Notice are declared null and void, it will be removed or replaced. In any case, this declaration of nullity will not affect the validity of the other provisions contained in this Legal Notice.
